Terms Of Service

1. Introduction

Welcome to Flare. By accessing or using our services ("Services"), including but not limited to visiting the Flare website or adding the Flare Bot ("Bot") to your Discord server, you ("User") agree to abide by these Terms of Service ("Agreement"). If you do not agree with any part of these terms, please discontinue the use of Flare immediately.

2. Definitions

In this Agreement:

• "Flare," "we," "us," and "our" refer to Flare and its affiliates, directors, officers, employees, and agents.
• "Services" means all products, features, applications, websites, or other services operated by Flare.
• "User," "you," and "your" refer to any individual or entity using our Services.

3. Eligibility

You must be of legal age in your jurisdiction to use Flare. If you are underage, you must have permission from a parent or legal guardian.

4. Service Usage

Flare provides its Services on an "as-is" basis, with no guarantees of uptime or reliability. You agree not to misuse the platform in any way, including but not limited to:

• Exploiting vulnerabilities, engaging in unauthorized activities, or violating applicable laws.
• Attempting to hack, disrupt, or gain unauthorized access to Flare's systems.
• Scraping, collecting, or harvesting any information without authorization.

5. Account Responsibility

You are responsible for all actions taken under your account. It is your duty to keep your credentials secure and report any unauthorized access immediately.

6. Compliance with Laws and Discord Policies

You must comply with all applicable local, state, national, and international laws and regulations.

You acknowledge that the use of the Services is subject to Discord's Terms of Service and Community Guidelines. Any violation thereof constitutes a violation of this Agreement.

Any violations of applicable laws, regulations, or Discord policies should be reported to Flare via email at dev.flarebot@gmail.com.

7. Prohibited Conduct

You may not use Flare for any unlawful, harmful, or abusive activities. This includes, but is not limited to:

• Harassment, spamming, distribution of malicious software, or any behavior that disrupts the experience of other users.
• Reproducing, duplicating, copying, selling, or reselling any portion of the Bot's functionality.
• Exploiting bugs, glitches, or vulnerabilities.
• Organizing, participating in, or encouraging harassment, "raids," or targeted attacks against Flare or its staff.

8. Enforcement Rights

Flare reserves the right, at its sole discretion, to:

• Suspend or terminate access to the Services, temporarily or permanently, with or without prior notice.
• Remove, disable, or restrict access to any content violating these terms.
• Take legal action against Users who violate these terms, including reporting to law enforcement authorities.
• Pursue any and all remedies available for violations of this Agreement.

9. Intellectual Property

All content, branding, and intellectual property associated with Flare remain the sole property of their respective owners. You may not copy, modify, or distribute any part of Flare's Services without explicit permission.

10. Refunds and Account Restrictions

If a User receives a refund under any circumstances, Flare reserves the right to blacklist said User's Discord account and permanently ban them from accessing all Flare Services.

11. Third-Party Relationships and Disclaimer of Liability

Flare is not affiliated, associated, or partnered with any Discord servers or communities that use our Services.

Users acknowledge that Flare exercises no control over the conduct, content, or data of third parties using our Services.

Flare disclaims any liability for actions, conduct, statements, or content generated by any User or server administrator.

12. Service Availability and Termination

Flare does not guarantee continuous, uninterrupted, or secure access to our Services. Various factors may interfere with the operation of the Services.

Flare reserves the right to refuse service, terminate accounts, or remove/edit content if a User's conduct violates applicable laws or threatens the integrity of the Services.

Flare reserves the right to terminate access to and use of the Services immediately without prior notice or liability for any reason, including but not limited to a breach of this Agreement.

All provisions of this Agreement that should survive termination shall continue to apply.

13. Indemnification

Users agree to defend, indemnify, and hold harmless Flare, its affiliates, and its respective officers, directors, employees, contractors, agents, licensors, suppliers, and successors from any claims, liabilities, damages, or expenses arising from violations of this Agreement.

14. Limitation of Liability

Under no circumstances shall Flare be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from access to or inability to use the Services.

15. Amendments

Flare reserves the right to modify, amend, or update this Agreement at any time at its sole discretion. Continued use of Flare after any changes constitutes acceptance of the revised terms.

16. Miscellaneous

If any provision of this Agreement is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement otherwise remains in full force.

This Agreement constitutes the entire agreement between Flare and the User regarding the Services and supersedes all prior agreements.
